Welcome to SMARCH, operated by SMARCH Ideell Förening, registered in Stockholm, Sweden ("we," "us," "our," "smarch").

These Terms and Conditions ("Terms") govern your access to and use of:

• Our platform services, including participant applications, team matching, collaboration tools, and optional hiring-partner visibility features ("Services")
• All related applications, features, and content

By accessing or using smarch, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations.

2. Acceptance of Terms

2.1 Binding Agreement

By creating an account, submitting applications, or using any part of our Services, you enter into a legally binding agreement with Smarch Ideell Förening.

2.2 Age Requirement

You must be at least 18 years old to use our Services. By using smarch, you represent and warrant that you meet this age requirement.

2.3 Capacity to Contract

Participants: Access to application submission, team matching, collaboration features, and optional hiring-partner visibility

Hiring Partners: Subscription-based access to anonymized opt-in participant profiles and related partner features (additional partner terms may apply)

4.4 One Account Per User

Each user may maintain only one active account. Multiple accounts by the same individual are prohibited and may result in suspension or termination.

5. User Responsibilities and Conduct

5.1 Lawful Use

You agree to use smarch in compliance with:

• All applicable Swedish, Polish, EU, and international laws and regulations
• These Terms and our Privacy Policy
• Any additional guidelines or policies posted on the Website

5.2 Prohibited Activities

You must NOT:

Content Violations:

• Post false, misleading, or fraudulent information
• Submit resumes, applications, or profiles belonging to others
• Upload harmful, offensive, defamatory, or inappropriate content
• Include discriminatory content based on race, gender, religion, nationality, disability, sexual orientation, or age

Technical Violations:

• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated tools, bots, or scripts to scrape, collect, or interact with our Services
• Reverse engineer, decompile, or attempt to extract source code
• Introduce viruses, malware, or malicious code
• Interfere with or disrupt the integrity or performance of our Services

Legal and Ethical Violations:

• Engage in fraudulent or deceptive activities
• Violate intellectual property rights (ours or others')
• Use the platform for spam, phishing, or unsolicited commercial communications
• Harass, threaten, or intimidate other users
• Impersonate any person or entity
• Use smarch for any unlawful purpose

Hiring-Partner-Specific Violations:

• Access participant information without an active subscription
• Share, resell, or redistribute participant data obtained through smarch
• Contact participants outside the platform without their explicit consent
• Discriminate in hiring or selection practices

6. Services Provided

6.1 Team Matching and Collaboration

• Skill-based matching to connect participants into complementary teams
• Anonymized, bias-aware matching based on experience, skills, and preferences
• Communication and collaboration facilitation between matched individuals

6.2 Optional Hiring-Partner Visibility

For Participants:

• Opt-in visibility to subscribing hiring partners (anonymized profiles initially)
• Control over profile visibility and hiring-partner interactions
• Meeting invitation system with accept/decline options
• Automatic opt-out when committed to active matched-team participation

For Hiring Partners:

• Subscription-based access to anonymized opt-in participant pool
• Interest expression and meeting scheduling features
• Full profile access upon participant acceptance
• Tiered subscription plans (details provided separately)

6.3 Application Processing

• Survey-based skill assessment
• AI-enhanced analysis for improved matching (anonymized data)
• Case management with unique smarch case numbers
• Progress tracking and status updates
